Overview

These Terms govern your purchase and use of our products, services, and AI-powered tools, including the Creative Review & Cataloging Tool (CRT).
By accessing or using our website or purchasing any product, you agree to these Terms.

Purchases

Purchases are processed securely through Gumroad and Stripe.
You agree to provide accurate and complete payment and contact information at checkout.
All payments are subject to the respective payment processor’s terms and privacy policies:

• Gumroad Privacy Policy

License

When you purchase a Phoenix Rising product, you receive a non-transferable, non-exclusive license for personal or business use as described on the product page.

You may not:

• Resell, sublicense, or redistribute the product or its outputs.
• Represent the product or any AI-generated outputs as your own proprietary technology.
• Circumvent or attempt to bypass licensing or activation mechanisms.
   

AI-Powered Tools & Data Use

Certain Phoenix Rising products, including the CRT, operate using OpenAI’s ChatGPT platform (GPT-5).
All user inputs and creative data entered in ChatGPT are processed directly by OpenAI under their own Privacy Policy and Terms of Use.

Phoenix Rising does not access, store, or control this data.

By using CRT or any AI-powered feature, you acknowledge and agree that:

• Outputs are generated by an automated system.
• Phoenix Rising is not responsible for the accuracy or interpretation of AI-generated results.
• You are responsible for reviewing and validating all outputs before public or commercial use.
   

Refund & Revisions Policy

Refunds are provided according to our published Refund Policy or as required by law.

Each purchase includes one complimentary revision or re-run within seven (7) days to correct technical errors or misinterpretations.
Beyond that window, new or modified requests are considered separate services.

Prohibited Uses

You may not:

• Copy, resell, or sublicense our products.
• Use our products or AI-generated outputs for unlawful, defamatory, or harmful purposes.
• Circumvent, disable, or modify licensing or security protections.
• Submit illegal or infringing content through our tools.
   

Violation of these Terms may result in license termination without refund.

Limitation of Liability

All products and services are provided “as is” and without warranty of any kind, express or implied.

Phoenix Rising Marketing & Entertainment, LLC is not liable for any indirect, incidental, or consequential damages resulting from your use—or inability to use—our products or any AI-generated content.

We do not guarantee specific results or outcomes from use of our tools.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved in the courts of San Diego County, California.
